and
SAMUEL FIELD et al, Appellees.
APPELLEES' ARGUMENT.
The Legislature of Pennsylvania, by an Act approved May 16,
1861, (Appellant's Paper-Book, Exhibit A, page 8,) required the
Councils of the City of Philadelphia to erect or cause to be
erected a good and substantial bridge over the River Schuylkill,
at or opposite to South street.  The Councils not heeding that
mandate, the Legislature, by a supplement approved April 5,1866,
(Appellant's Paper-Book, Exhibit B, page 9,) appointed a number
of the citizens of Philadelphia as a commission to erect said bridge,
and directed that if the Councils of Philadelphia shall, before
the first day of July, A. D. 1867, enter into a contract or com-
mence the erection of a free bridge over the River Schuylkill, at
South street, then the powers of said Commissioners shall be
vested in the Councils of Philadelphia. The Councils did not
commence the erection of the bridge, and the powers of said Com-
missioners did not become vested in them. And the Legislature,
by a further supplement, approved April 5, 1867, increased the
number of Commissioners by appointing additional citizens of Phila-
delphia, and the Mayor and the Presidents of the Councils of said
