STATEMENT OF FA(7,TS.
This was an action brought by the plaintiff against the
Sheriff for the escape of John D. Williamson, who had
been arrested upon execution against his person, and was
confined within the liberties of the jail, having given the
usual bond to such Sheriff.
The action was tried before Mr. Justice Hoffman,
without a jury, one being waived, pursuant to the Code.
A decision was rendered in favor of defendant, on
which judgment was entered.      From this plaintiff
appeals.
The following state of facts was admitted by the
parties and found by the Court:
