Dear Mr. McWilliams:
*1 Attorney General Mike Moore has received your request and has referred it to me for research and reply. You represent the Sunflower County
Board of Supervisors. Citing the new version of Miss. Code Ann. Section 31-5-51 (Supp. 2000), you ask whether a contract for hauling and
disposing of waste tires falls within the meaning of a contract for construction, alteration, or repair of any public building or public work. Section
31-5-51 requires persons entering into such contracts with the county to have one million dollars in liability insurance. You state that your county is
contemplating contracting with a solid waste tire hauler approved by the Department of Environmental Quality to haul and dispose of waste tires in
Sunflower County. Your question is whether the statutory requirement of one million dollars in insurance applies to persons who contract with the
county to haul and dispose waste tires.
*1 We opine that a contract for hauling and disposing waste tires is not one for construction, alteration, or repair of a public work, and thus the
contractor would not be required by Section 31-5-51 to have a million dollar level of insurance.
