Attorney General Mike Moore has received your recent letter on behalf of the Village of
Gattman and has asked me to respond. Your letter states:
Is it permissible for the Village of Gattman to rent out our backhoe to a qualified
operator? We need to regularly fire up our machine and we are in need of money, but we
don't want to do anything wrong.
Also, could you send us information on the rights and responsibilities of the Mayor and
Aldermen? They are frequently asked to do things in their capacity as village leaders
which would appear to be beyond their job responsibilities.
We do not find authority for a municipality to rent equipment, such as a backhoe, to
individuals or groups in the private sector as a profit making venture.
