Re: Determination of assessed value
Dear Mr. Shackelford:
Attorney Genera Mike Moore has received your request for an official opinion of this
office and has assigned it to me for a reply. Your letter has been attached for reference. You
inquire:
Can we as county assessors use invoices (new and used prices) to determine
assessed value?
Section 27-35-15, Miss. Code Ann. states in pertinent part:
(1) The tax assessors shall annually appraise all personal property subject
to taxation in their respective counties at true value and assess it in proportion
thereto....
In order to assist the tax assessors in their assessment, the Mississippi State Tax
Commission has promulgated Property Tax Bureau Rule 8, Appraisal of Personal Property,
which you attached with your request. Rule 8 provides that in the case of industrial and business
personal property, the State Tax Commission (STC) guide is to be used, and [p]rices from the
STC manual should be classified using Marshall Valuation Service and multiplied by the
appropriate percentage good factor supplied by the STC according to age.
Rule 8 goes on to state:
Any deviations from the STC pricing guide must be documented in the assessor's
file. Invoices showing prices in arm's length transactions which reflect market
