Re: County Authority to Borrow Funds through Planning and
Development District
Dear Mr. Griffith:
Attorney General Mike Moore has received your request for an
opinion and has assigned it to me for research and reply. Your
letter asks:
South Delta Planning and Development District, Inc. is
interested in working with Bolivar County, Mississippi
on a potential project for the Rosedale-Bolivar County
Port which will involve a distribution center for the
storage and transfer of cotton    seed.    South Delta
Planning and Development District has two loan programs
that could be utilized for this project, one of which
is a Farmers' Home Administration IRP (Intermediary
Relending Program) operated in conjunction with the
Farmers' Home and Rural Development Administration, and
the second is an Economic Development Revolving Loan
Program operated through South Delta Planning and
Development District.
My question, for which I am requesting an Attorney
General's Opinion, is whether the Bolivar County Board
of Supervisors has the legal authority to borrow funds
through South Delta Planning and Development District
under the two referenced programs, whether the County
can legally    access said  funds and, if so, what
statutory requirements or other requirements of state
law would apply to the Board of Supervisors with
reference to participating in these loan programs.
In response, Section 19-3-40 of the Mississippi Code, the Home
Rule statute, gives boards of supervisors the power to adopt any
