Brush Pickup in
Unincorporated Areas
The Honorable Meg Gorecki
State's Attorney, Kane County
100 South Third Street
Geneva, Illinois 60134
Dear Ms. Gorecki:
I have Assistant State's t M. Katherine Moran's
letter wherein she forward you inqu r regarding whether a
township or a township o distra t may ovide residents of
unincorporated areas of t e townsh p free brush pickup on either
a seasonal or ot per ic as . For the reasons hereinafter
stated, it s my opinio that a township has authority to provide
brush picku t reside t of unincorporated areas only with
referendum app s provided in article 210 of the Township
Code (60 ILCS 1/210-5 et sea. (West 2000)),. Further, it is my
opinion that a township road district has no authority to provide
such services.
