Deutschen Juristentags 2012 in Mfinchen zu der Frage prdisentierte: ,,Brauchen Konsumenten und Unternehmen eine neue Architektur des Verbraucherrechts? Der Verfas- ser plidiert ffur die Auslagerung des deutschen Verbraucher- rechts aus dem Bflrgerlichen Gesetzbuch (BGB) in ein Son- dergesetz mit Verordnungsteil nach dem Vorbild des franz6- sischen Code de la Consommation. Der schwerfillige Tan- ker BGB kann mit der Dynamik des wendigen Verbraucher- rechts nicht Schritt halten, der soziale Charakter des Ver- braucherrechts kisst sich deutlicher sichtbar machen und leichter erhalten, in das 6ffentliche Recht hineinragende Regeln lassen sich leichter integrieren, modeme Formen des Dienstleistungsvertragsrecht, die auf vielfdltige Gesetze verteilt sind, lassen sich in einem Sondergesetz eher zusam- menffhiren, prozedurale Regeln flber die Ausgestaltung des individuellen, des kollektiven, des judiziellen wie des admi- nistrativen Rechtsschutzes mit materialen Vorschriften des Verbraucherrechts verbinden. Vorliegend werden die Leitli- nien eines beweglichen Systems skizziert undjedenfalls die Prinzipien formuliert, die die Funktion und Reichweite des avisierten beweglichen Systems verdeutlichen. Micklitz (L) Professor, European University Institute Florence/ University of Bamberg (currently on leave), European University Institute, Law Department, Villa Schifanoia, Office 30, Via Boccaccio 121, 50133 Firenze, Italy, E-Mail: <hans.micklitz(deui.eu> This paper, based on a comprehensive report for a German forum of lawyers, the Deutscher Juristentag,2 pleads for the reshaping of consumer law into a special law which includes a part dedicated to an ordinance according to the model of the French 'Code de la Consommation'. The heavy tanker of the German civil law code, the BGB, cannot keep up with the dynamics of the agile consumer law. By means of a spe- cial law, the social character of the consumer law can be il- lustrated more clearly and maintained more easily; rules which are influenced by public law are easier to integrate; and modem forms of the law on service contracts which can be found in several acts can be merged. Finally, procedural rules on the arrangement of the individual, collective, judi- cial and administrative courses of redress are more readily combined with substantive rules of consumer law. Thus the focus lies in outlining the guidelines of such a model and on formulating the principles which illustrate the function and scope of the mentioned movable system. 2. The Scene The static, cosy consumer protection law of the 1970s and '80s belongs to the past.
