1. The Importance of a Weapon-free Outer Space
In 2007 the international community celebrates the 40' anniversary of the
Outer Space Treaty (OST) in a climate where the weaponization of space
seems to be possible. The space environment is evolving rapidly in terms of
actors, space applications and space traffic. Today, the technologies for
deploying objects into space which can harm satellites are becoming available
in major space-faring nations. On the other hand, a web of international and
national laws and regulations has become more extensive. Additionally, there
are only few legal restrictions and barriers on the use of space weapons (SW).
The preamble of the Outer Space Treaty (OST) from 1967 underlines the
common interest of all mankind in the progress of the exploration and use of
outer space for peaceful purposes and declares it should be carried on for
the benefit of all peoples. According to Art.I.1 1967 OST, outer space is a
sovereignless territory, of which the use shall be carried out for the benefit
and interests of all countries (...) and all mankind.2 Consequently, security in
space should not be pursued exclusively in the national interest by only one
