The recent interest in understanding the psychology of the
battered woman and her family has brought about a new interplay
between psychology and the law. This interaction usually occurs
when battered women are involved in civil litigation such as sepa-
ration, divorce, child custody, and personal injury cases; when the
violence comes to the attention of the criminal justice system, such
as in assault and homicide cases; and when lawyers and psycholo-
gists advocate together for community action and legislation. Al-
though, historically, violent families have been brought to the at-
tention of the mental health and judicial systems, it has been only
within the past decade, since this new alliance between attorneys
and psychologists has arisen, that the courts have begun to under-
stand the nature of battering relationships. Previously, courts re-
lied on popular myths to explain the behavior and motivations of
battered women.'
Such myths included the belief that battered women are mas-
ochistic, that they stay with their mates because they like beatings,
that the violence fulfills a deep-seated need within each partner, or
that they are free to leave such relationships if that is what they
