OPSOMMING
Gevaarlike breine: Die voorspelling van toekomstige gevaarlikheid in
gevaarlike oortreders. Kan die neuroswetenskappe help?
Die voorspelling van toekomstige gevaarlikheid was tot dusver klassiek gesetel binne die
veld van forensiese psigiatrie. Neurowetenskappe word onlangs toenemend aangevoer
in strafverhore tesame met psigiatriese getuienis. Die veld van neurowetenskappe het
onlangs ontwikkelings getoon nie net ten aansien van die assessering van strafregtelike
aanspreeklikheid nie, maar ook binne die konteks van die voorspelling van toekomstige
gevaarlikheid in gevaarlike oortreders. Kognitiewe neurowetenskappe wat essensieel
neerkom op 'n analise van die struktuur en funksionering van die brein, word toenemend
benut ten einde aan te toon hoekom individue betrokke raak in geweldaddige, aggressiewe,
en impulsiewe gedrag. In hierdie aantekening word die rol van neurowetenskappe ge-
evalueer binne die konteks van die voorspelling van toekomstige gevaarlikheid in
gevaarlike oortreders. Laasgenoemde sal ondersoek word aan die hand van artikels 286A
en 286B van die Strafproeseswet 51 van 1977, welke bepalings spesifiek handel oor die
proses wat gevolg moet word in gevalle waar gevaarlike oortreders gevonnis moet word.
Daar sal verder aangedui word dat ontwikkelinge binne die veld van neurowetenskappe
sodanig is dat sodanige getuienis in samehang met forensiese psigiatriese getuienis aan-
gebied moet word ten einde die hof met 'n meer holistiese perspektief te voorsien wanneer
toekomstige gevaarlikheid oorweeg moet word.
1 Introduction
It was an act which destroyed a beautiful family forever and brought great pain
and sorrow to them. An act which has broken their hearts and of those who knew
and loved Steven. An act that shocked the nation. It was an act in which I robbed
little Steven of his love, his innocence, his purity; an act in which I robbed him of
his little private body and worst, an act in which I robbed him of life - his right to
live. I took away little Steven's life - the life of a 6-year-old child who never did
any harm - and my life should be taken away from me, no matter how many tears
I've shed or how great my remorse. And in this, I call upon the nation to stand with
me and petition the Government to bring back the death sentence, and in the
judgment it be passed onto me and that I be executed for this terrible deed. The full
wrath of the law must fall upon me and in no way should it have any mercy, for I
did not have mercy on little Steven and therefore deserve no mercy (S v Olivier
2007 2 SACR 596 (C) par 29).
Thesed are the words of Theuns Olivier, a previously convicted paedophile,
who brutally sodomized and killed Steven Siebert, a six-year-old boy on
23 December 2005. It was a beautiful sunny day in Plettenberg Bay. Steven was
playing on the beach. Olivier later lured Steven to his home. Little did Steven
know what was awaiting him. Olivier brutally sexually assaulted Steven and then
strangled him with a telephone cord and watched him die. Olivier placed the
body in a cupboard and shaved his beard (para 7).
Olivier was convicted of kidnapping, indecent assault, and murder.
Forensic psychiatric evidence revealed unanimously that Olivier would con-
tinue to be a high risk for repeat offending and remained a danger to children
with a poor prognosis. Evidence disclosed that Olivier had a lengthy history of
