* Attorney at Law, licensed in Texas and Minnesota; B.E.D., Texas A&M University;
J.D., South Texas College of Law; currently pursuing a Ph.D. in History at the University of
Iowa; founding member of the National Transgender Advocacy Coalition (NTAC). The
author would like to thank Prof. Henry Horwitz for his insight and Prof. Wendie Schneider
for offering me a research assistantship for the Summer of 2004, during which, while
working on her projects, I stumbled across a number of items that have proven invaluable
for this article, items of which I otherwise would not have been aware. The author would
also like to thank the following individuals who helped in various ways at various stages of
the writing of this article: Sandy Stevens, Gwen Smith, Ethan St. Pierre, and Alyson
Meiselman; and, special thanks to my cat, Eve, for staying off of my computer's keyboard
long enough for me to finish the article. I dedicate the article to the memory of Darryl
Fearon who, on July 16, 2004, was stabbed to death in the West Village, New York City,
while coming to the aid of three transgendered women who were being harassed.
