Even if there is no possibility to develop and implement a generally valid formula for interaction between states and private actors in the process of ensuring national security and defense, the outsourcing of specific functions of law enforcement and the degree of involvement of private military and security companies substantially affects state sovereignty and is one of the biggest challenges to public international law in general and to the legal mechanisms governing these processes in particular. The mechanisms, procedures and scenarios for collaboration between states and private military and security companies in order to carry out in practice functions that belonged exclusively to state structures are the subject of research in this article. EVALUAREA IMPACTULUI IMPLICARII ENTITATILOR PRIVATE IN CADRUL CONFLICTELOR AR- MATE CONTEMPORANE ASUPRA MONOPOLULUI STATULUI DE UTILIZARE A FORTEI MILITARE Participarea activa a companiilor militare si de securitate private in cadrul conflictelor armate contemporane genereaza un impact puternic asupra monopolului statului de utilizare a fortei militare. Chiar daca nu exist! posibilitatea elaborlrii si implementlrii unei formule general valabile de interactiune dintre state si actorii privati in procesul de asigurare a securitltii si apararii nationale, externalizarea functiilor specifce organelor de fort! si gradul de implicare a companiilor militare si de securitate private afecteaz! substantial suveranitatea statelor si constituie una dintre cele mai mari provocari asupra dreptului international public in general si asupra mecanismelor juridice de reglementare a acestor procese in special.
