No task confronting civilization is more urgent than that of channel-
ing technology to enhance rather than destroy the fabric of life and
the dignity of man.... [T]he wise control of technology demands,
among other things, a sensitive understanding of the role that law
can play.'
In November 1996, a district court judge upheld the Protection of
Children Against Sexual Exploitation Act of 1977, but stated that a
cartoon character, a computer-animated image, a person eighteen or
over who appears to be a minor, or an image of adults 'doctored,' by
computer or other means to appear younger are not covered by the
statute.' Thus, in order to prosecute a defendant, the government
was required to prove that the depictions for which prosecution was
being sought were of actual minors.
