PUBLIC CELEBRITY v. SCANDAL MAGAZINE-
THE CELEBRITY'S RIGHT TO PRIVACY
Irwin 0. Spiegel*
Is the right to privacy the possession of mediocrity alone, which a person
forfeits by giving rein to his ability, spurs to his industry, or grandeur to
his character?
Parker, C. J.
Roberson v. Rochester Folding Box Co.
171 N.Y. 538, 556,64 N.E. 442,447 (1902)
The press is overstepping in every direction the obvious bounds of
propriety and of decency. Gossip is no longer the resource of the idle
and of the vicious, but has become a trade, which is pursued with industry
as well as effrontery. To satisfy a prurient taste the details of sexual rela-
tions are spread broadcast in the columns of the daily papdrs. To occupy
the indolent, column upon column is filled with idle gossip, which can
only be procured by intrusion upon the domestice circle.
Samuel D. Warren and Louis D. Brandeis
The Right to Privacy, 4 HARv. L REv. 193, 196 (1890)
[Als to certain matters the individual feels and knows that he has a
right to exercise the liberty of privacy, and that he has a right to resent any
invasion of this liberty, and, if the law will not protect him against inva-
sion, the individual will, to protect himself and those to whom he owes
protection, use those weapons with which nature has provided him....
Thus the peace and good order of society would be disturbed by each
individual becoming a law unto himself to determine when and under
what circumstances he should avenge the outrage which has been per-
petrated upon him or a member of his family.
Cobb, J.
Pavesich v. New England Life Ins. Co.
122 Ga. 190, 212, 50 S.E. 68,77 (1905)
TRAPPER'S STORY OF HOW HE SHOT
PUBLISHER OF 'CONFIDENTIAL' IN JUNGLE
'I never had any intention of hurting Harrison, although I was sore
because of the story in the magazine,' Weldy told reporters.
'The story' in the current issue of Confidential concerns Weldy and his
former wife, Peruvian beauty Pilar Palette, and the purported circum-
stances of her meeting and marriage with Movie Actor John Wayne.
Harrison, 51, was wounded by a blast from Weldy's shotgun while the
two were arguing heatedly over the article in the expose magazine.
