Abstract

In order to avoid the difficulties which could arise in practice, we consider, de lege ferenda,
that it is necessary to set out a regulatory framework for the temporary employment contract
as a contract for unspecified period, on the basis of which the temporary employee should be
remunerated  between missions with wages that should not be lower than the minimum gross
wages at national level, guaranteed for payment.

Within this framework, for each mission an additional act should be annexed to the temporary
employment  contract on the basis of which the remuneration owed to the temporary employee
should be established by direct negotiation with the temporary employment agent, without
falling below the level of the wage established in the temporary employment contract and with
the concurrent observance of the wage received by the comparable employee of the user.

Conform  Directivei 2008/104/CE a Parlamentului European gi a Consiliului din 19 noiembrie 2008
privind munca  prin agent de muncS  temporara', prin ,,lucrator temporar se intelege un
lucr~tor care a incheiat un contract de muncA sau se aflS intr-un raport de munci cu un agent
de muncS  temporarS in vederea punerii sale la dispozilia unei intreprinderi utilizatoare pentru a
lucra temporar sub supravegherea §i conducerea acesteia [art. 3 alin. (1) lit. c)].

Aga  fiind, deli directiva menlionata reglementeazS nu doar situalia ceLui care incheie un
contract individual de muncS, ci §i pe a celui aflat intr-un raport de muncA ce are un alt izvor
decht un astfeL de contract2, in Codul munci [art. 88 alin. (2)] a fost menjinuts, prin Legea
nr. 40/20113, sintagma ,,saLariat temporar. Opliunea Legiuitorului roman se justific6 prin
prisma sferei de reglementare a Codului muncii prin raportare La prestarea muncii in baza unui
contract individualde muncS (art. 2).
