Ces deux aspects representent des etablissements juridiques innovateurs qui ont ete introduits dans le Code civil du 2009 presentant un caractere de nouveaute. Quoique les references du Code civil d la notion de tiers sont nombreuses, ii n'y a pas de reglementation unitaire de ce concept Il y a plusieurs articles tant en matiere attribuee d la fiducie (c'est-d-dire les articles 773-791 du Code civil), qu'en matiere de l'administration des biens d'autrui (c'est-d-dire les articles 792-857) faisant reference d la notion de tiers, l'auteur examinant la maniere d'interpretation et d'application de ces articles specifiquement concernant cette notion. THIRD PARTY IN THE MATTER OF THE FIDUCIARY AGREEMENT AND THE ADMINISTRATION OF THE PROPERTY OF ANOTHER ABSTRACT In this article, the author examines the legal concept and notion of third party specifically in the matter of the fiduciary agreement and the administration of the property of another. These two elements are innovating legal institutions which were introduced in the Civil Code from 2009 as novelty. Although the references in the Civil Code to the notion of third party are various, there is no uniform regulation of this concept There are several articles both in the matter allocated to the fiduciary agreement (namely, Articles 773-791 of the Civil Code), and in the matter of the administration of the property of another (namely, Articles 792-857) referring to the concept of third party, and the author examines the manner of interpretation and application of these articles specifically relating to this notion.
