         LA NÉCESSITÉ DE PROTÉGER LES CONSOMMATEURS. COMMENT
           PEUT-ON INTERVENIR: PAR OU SUR CERTAINS ORGANISMES
                                     DE DROIT?

                                     RÉSUMÉ
           Le présent article analyse quatre lois nouvelles de la perspective de la nécessité
       et des possibles effets, respectivement des projets d'amendement de certains lois,
       visant à garantir un « équilibre » entre les consommateurs et les professionnels du
       système financier-bancaire, dans une tentative d'analyser à quel point, mais aussi de
       quelle manière le législateur doit intervenir dans les situations où il considère que
       l'équilibre entre les consommateurs et les professionnels n'existe plus. En outre, on
       essayera de montrer que certains projets (tels que l'élimination du «hasard») ne
       peuvent pas être accomplis, et la ténacité dans la « solution » de certaines situations
       réelles ne peut pas être atteinte de n'importe quelle façon, mais sans porter
       gravement atteinte à certaines institutions de droit.

       Mots-clés: la protection des consommateurs; partager les risques; la liberté

          THROUGH OR IN RELATION TO CERTAIN LAW INSTITUTIONS?

                                     ABSTRACT
           This article examines four new laws from the perspective the need and of the
       possible effects, respectively draft amendments of certain laws, intended to ensure a
       balance between consumers and professionals in thefinancial and banking system,
       in the attempt to examine to what extent, and also in which manner the legislator
       must intervene in those situations where it considers that there is no more balance
       between consumers and professionals. Moreover we will try to show that certain
       requirements (such as the removal of hazard) may not be attained, and the
       toughness in solving certain real situations may not be achieved by any means,
       without seriously prejudicing certain law institutions.
