Daca in sistemul declarativ intinderea protectiei marcilor este data de produsele qi / sau serviciile pentru care marca este efectiv folosita, agadar de un element de fapt, in sistemul atributiv intinderea protectiei este dictata de mani- festarea de vointa a solicitantului, prin propria alegere,facuta la momentul depunerii cererii de marca. Ca atare, una dintre principalele critici aduse sistemului atributiv de protectie a marcilor a fost faptul ca solicitantii pot abuza de procedura de inregistrare pentru a obtine protectie pentru o sferd mai largo de produse qi / sau servicii decat cele pentru care marca este, de fapt, utilizata. fn acest context, Clasificarea de la Nisa reprezinta un instrument esential acceptat qi utilizat in majoritatea statelor lumii pentru desemnarea produselor qi serviciilor, larga sa rdspandire fiind determi- nate, la nivel practic, de necesitatea unei protectii unitare a drepturilor la nivel transfrontalier. La nivel legislativ, acesta a fost impus prin intermediul acordurilor internationale. Vom vedea insa, in cele ce urmeazd, faptul ca jurisprudenta europeand a incercat sa diminueze neajunsurile sistemului atributiv de protectie, incurajand titularii de marci sa solicite protectie pentru produse qi servicii specifice, in deplind congruenta cu utilizare respectivelor marci pe piata.
