The Charter of Fundamental Rights of the European Union: Horizontal Direct Effect, Extraterritorial Application and a Surprising Application in Case Privacy International

In the introduction, we will discuss general notions about the Charter. In section II, we will analyze the direct horizontal effect of the Charter through the comparative analysis of two CJEU judgments, the Association de mediation sociale and Bauer. In Section III, we will discuss the extraterritorial application of the Charter as an automatic effect of the extraterritorial application of EU secondary law. In Section IV, we will analyze the CJEU's judgment in Privacy International to see how, through a brave interpretation, the provisions of the Charter can enter areas of state sovereignty. In introducere, vom aduce in discutie anumite notiuni generale despre carts, in sectiunea II vom discuta Avocat definitiv in Baroul Bucuresti.
