DNA AND DADS: CONSIDERATIONS FOR LOUISIANA IN
USING DNA BLOOD TESTS TO DETERMINE PATERNITY
The purpose of paternity testing is to provide a clear, objective and
detached opinion-based on scientific data-as to whether a partic-
ular man is the actual, biological father of a particular child. As
such, the purpose is to help-to ensure, in effect-that justice is fair
and without bias.'
I. INTRODUCTION
Even though in Louisiana, the husband of the mother is pre-
sumed to be the father of all children born or conceived during the
marriage,2 many illegitimate children are born in this state each
year. State law favors legitimation, and Louisiana adheres to its
strong policy of protecting innocent children born during marriage
against attacks of paternity.' However, many rights and obliga-
tions arise once the parent-child relationship is established,
whether legitimate or illegitimate, and today, the sources of those
rights and obligations are roughly the same.4
