Rezumat:
Judecatorul national, Fn cele ce urmeaza cel rom.1n, are privilegiul si
responsabilitatea de a aplica si de a interpreta dreptul Uniuni Europene in cauzele
dedusejudecAtii. Cauzele din domeniul societtilor- in special din domeniul libertatii
de stabilire si mai putin In privinta directivelor ,,societare - au format obiectul unor
solutii interesante, In Romania si Fn alte state. Desi situatiile nu sunt identice,
asemAnarea dintre o netrimitere din Romania si cauza Cartesio, ne Fndeamn6 la
unele reflectii cu privire la participarea rom~neasca la cooperareajurisdictionaA dintre
instantele nationale si Curtea de Justitie a Uniunii Europene.
Abstract:
The national judge, hereinafter the Romanian one, has both the privilege and
responsibility to apply and interpret European Union law in cases before he/she Cases
in the field of company law - especially in the field of freedom of establishment and
less in what regards company law directives- are subject-matter for certain interesting
pronouncements, in Romania and other states Even if the circumstances are not
identical, the resemblance between a refusal to refer to the CourtofJustice originating
