A Speedier Remedy in Personal
Injury Cases

Mr. Appleman is a member of the bars of Illinois, Massachusetts,
District of Columbia, Kentucky and the U. S. Supreme Court, past
president of the Federation of Insurance Counsel and formerly Dean of
the International Academy of Trial Lawyers. This article is concerned
with the responsibility of lawyers in expediting judicial remedies.
USTICE DELAYED is justice denied. As often repeated as that
statement has been, we must never lose sight of its significance.
To the layman, law is judged by the courtroom. The trial is the
drama, the real life play, which captures the imagination. An emotion-
charged scene frequently is emblazoned in headlines. That which
takes place in the conference room, or in the recesses of a lawyer's
office, is discreet and attracts little attention. But that which occurs
in the bright flame of publicity, in the presence of jurors, witnesses
and spectators, molds the opinion of the public as to justice, the
legal process and the Bar.
It is not our selfish interests with which we must be concerned
in expediting judicial remedies. We, as lawyers, serve only one
function. That is, as counselors or advocates, to help bring justice
in its truest sense to our fellow citizens.
Objectives of Justice
Every man, every woman, is entitled to expect these things:
First, a right to a hearing before a tribunal where questions of fact
and the truthfulness of testimony may be determined by a group of
persons drawn from all walks of life bringing their common experi-
ences into focus upon his problem. Second, a tribunal presided over by
a man of equable temperament, impartial in decision, able in the law.
Third, representation by an advocate of skill and of unimpeachable
integrity. Fourth, procedures whereby all relevant facts can be
brought forward, with justice unimpeded by legal legerdemain. Fifth,
a speedy hearing conducted while witnesses are available, with
memories fresh, with a verdict rendered at a sufficiently early date that
it may help to resolve not only the legal but the economic problems
of the parties.
