Abstract
The ELI/UNIDROIT proposal for EU Rules of Civil Procedure is an ambitious and
remarkable accomplishment. Focusing on Part VII of that project - on Access to
Information and Evidence - this article illustrates two key differences between American
principles and the aspirations of the framers of the EU Rules proposal. These are (a) the
very different role of the judge in resolving factual disputes, which must be left to the
jury in the US, and (b) the handling of access to evidence, which Americans call discovery.
Le projet ELI/UNIDROIT des Regles modeles europeennes de procedure civile est un
accomplissement ambitieux et remarquable. Letude de la partie VII dudit projet sur
lAcces aux informations et preuve  illustre deux diferences fondamentales entre les
principes americains et les aspirations des redacteurs du projet des regles europeennes.
Ce sont les roles tres diferents du juge dans la resolution des litiges de faits, dont le soin
est laisse au jury aux Ptats-Unis (a), ainsi que la gestion de l'acces aux preuves, que les
americains appellent discovery (b).
Der ELI/UNIDROIT-Vorschlag fur EU Rules of Civil Procedure ist eine ambitiuse und
bemerkenswerte Leistung. Eine Fokussierung auf Teil VII dieses Projekts - ,,Zugang zu
Informationen und Beweismitteln - veranschaulicht zwei wesentliche Unterschiede
zwischen den amerikanischen Prinzipien und den Bestrebungen der Verfasser des
EU-Regelungsvorschlags. Diese sind (a) die sehr unterschiedliche Rolle des Richters
bei der Erstellung des streitigen Sachverhaltes, die in den USA den Geschworenen
vorbehalten ist, und (b) die Handhabung des Zugangs zu Beweismitteln, von den
Amerikanern ,,discoverygenannt.
