Misconduct in Higher Education: How
Lawyers Should Assist Universities in
Fortifying Ethical Infrastructure

    On May 16, 2018, Michigan State University announced
that it had reached a $500 million agreement to settle claims
asserted by survivors of the largest sexual assault case in sports
history.1 More than 300 women sued, asserting that the univer-
sity had ignored or dismissed complaints that Larry Nassar, the
former doctor and Michigan State employee, had abused female
gymnasts and other athletes for decades.2
    Shortly after the announcement of the settlement, the U.S.
Senate Subcommittee on Consumer Protection, Product Safety,
Insurance, and Data Security convened a hearing entitled, Pre-
venting Abuse in Olympic and Amateur Athletics: Ensuring a
Safe and Secure Environment for Our Athletes.3 The hearing
shed light on how universities commonly handle allegations re-
lated to sexual misconduct.4 In her hearing testimony, Lou Anna
