On March 6 and 8, 1972, the Senate and the House of Representatives,
respectively, adopted the Equal Employment Opportunity Act of 19721
amending Title VII of the Civil Rights Act of 1964.2 When President
Nixon signed it into law another step toward effective enforcement of
the civil rights guarantees of the Constitution was taken. Although
the 1964 Act had fully acknowledged the public responsibility to ensure
equal opportunity for basic individual needs such as housing and
education, equal employment opportunity was left as a private wrong
to be redressed through private action. This denial of society's com-
mitment to equal employment opportunity proved significant, and
the principles expressed in the 1964 Act were never fully translated
into policy.
While the 1964 Act did establish a federal agency to deal with the
