INTRODUCTION
The growing focus on global warming as a serious public policy
issue has amplified the role of the courts in addressing the fallout
of climate change.1 The U.S. Supreme Court's recent decision in
Massachusetts v. Environmental Protection Agency found that the
Environmental Protection Agency (EPA) has statutory authority to
regulate carbon dioxide (CO2) emissions from motor vehicles as air
pollution under the Clean Air Act.2          Several less-visible lawsuits
