Buscou-se, em um primeiro momento, examinar-se a posigio doutrindria em relagio 6 natureza juridica das medidas protetivas de urg~ncia, estabelecendo-se critbrios para a andlise do cunho juridico do mencionado instrumento protetivo. A seguir, destacam-se os reflexos procedimentais decorrentes da compreensio quanto 6 natureza civel das medidas protetivas de urg~ncia, relatando-se a experi~ncia vivenciada no Juizado da Violdncia Domstica e Familiar contra a Mulher da Comarca de Florian6polis/SC. ABSTRACT: This article has how central objective studies the legal nature of urgent protective measures, innovative institute implemented by the Law n. 11.340/06, also known as Maria da Penha Law. At first, was examined the position of the doctrinaire on the legal nature of urgent protective measures, defining criteria for the analysis of the legal nature of the protective instrument mentioned. The folowing, was looked the procedural consequences arising from the understanding of the civil nature of urgent protective measure, reported the experience in the Court for Domestic and Family Violence against Women in the Florian6polis county.
