A LEGISLATION
The Supreme Court Act 59 of 1959 was not amended in 1988.
A new rule 68 of the uniform rules of court (and the tariff of fees
and charges of deputy sheriffs) was substituted for the old by GN
R1421 GG 11422 of 15 July 1988 (Reg Gaz 4230).
A new Appellate Division rule 10 (attorneys' fees) was substituted
for the old by GN R1766 GG 11488 of 2 September 1988 (Reg Gaz
4255).
The rules regulating the conduct of the proceedings of the Orange
Free State Provincial Division (sittings and vacations) were
amended by GN R2273 GG 11572 of 11 November 1988 (Reg Gaz
4280).
Except for the repeal of s 54A (inserted by s 2 of Act 34 of 1986
and regulating the application of Black laws by magistrates' courts)
by the Law of Evidence Amendment Act 45 of 1988 (GN 829 GG
11274 of 22 April 1988), the Magistrates' Courts Act 32 of 1944 was
not amended by Parliament in 1988. Amendments to the Act were
brought about by ss 3, 4, 5, 7, 8 and 9 of the Magistrates' Courts
Amendment Act 25 of 1987 (see 1987 Annual Survey 399). In terms of
Proc R176 GG 11063 of 11 December 1987 (Reg Gaz 4158), the date
of commencement of the amendments was 1 January 1988. The
amendments brought about a change in wording in s 7, the intro-
duction of s 7A, dealing with the custody of civil summonses, returns
thereto and access thereto, and, in respect of ss 29, 46, 50, 651 and
74, the deletion of references to specified sums of money and the
substitution for them of the phrase 'the amount determined by the
Minister [ofJustice] from time to time by notice in the Gazette'. Such
determinations by the minister were made by GN R2736 GG 11063
of 11 December 1987 (Reg Gaz 4158), with effect from 1 January
1988. The amounts so determined by the minister in respect of s 29
(jurisdiction in respect of causes of action) are: RIO 000 (value of
property of which delivery or transfer is claimed in terms of
s 29(l)(a)); RIO 000 (value to occupier of a right of occupation in
actions of ejectment in terms of s 29(l)(b); R30 000 (claim based on
liquid document or mortgage bond, in terms of s 29(l)(d)); R30 000
(claim or value of property in dispute in actions on or arising out of
