International Environmental Law and the Pacific
Island State of Niue
The coral atoll of Niue is located in the South Pacific Ocean, 2,400 kilometres
north-east of New Zealand at latitude 190S and longitude 1690W and is approxi-
mately 480 kilometres east of Tonga, 660 kilometres south-east of Western Samoa
and 980 kilometres west of Rarotonga. Niue is known as the largest and highest
coral atoll in the world, 21 kilometres long by 17 kilometres wide with an area of
259 kms2. The tropical island lies in the zone of the south-east trades with two
distinct dry and wet seasons. The mean annual rainfall is 2,180 millimetres
although this can be highly variable.
In July 1991, Niue completed its Country Report' in anticipation of the 1992
United Nations Conference on Environment and Development (UNCED) held in
Rio de Janeiro. This process, and the subsequent efforts by Niue to implement
initiatives from UNCED, forced Niue to address the impact of international
environmental law upon its national environmental laws. This note addresses this
process and seeks to draw some conclusions on the impact of international envi-
ronmental law upon Niue. A brief overview is first given of Niue and its political
structures.
Background
Niue is thought to have been inhabited for around 1,000 years. Niueans are
Polynesians and its early settlers are believed to have arrived from Tonga, Western
Samoa and Pukapuka in the Cook Islands. The average population level recorded
