INTRODUCTION
Public participation and transparency are hallmarks of American
administrative law, but this has not always been the case. Rather, there has
been a steady trend toward greater public participation and transparency as
the concept of the administrative state has evolved. Today, the
administrative law of the European Union (EU) is not known for fostering
public participation or transparency, but it appears there is potential for that
to change in the future. Moreover, the recent rejection of the Lisbon Treaty
