RESTATEMENT OF TORTS

Questions Suggested for Discussion at
the Fifteenth Annual Meeting
May 6-8, 1937
Discussion is not confined to the questions pre-
sented here. You are earnestly requested to raise any
further points which occur to you.
1. §1301, Comment c. Is the Institute justified in
repudiating the rule adopted by some courts that even
though there is no loss of affection, the plaintiff may
nevertheless recover on the theory that lie was entitled
to the opportunity for a recouciliation without inter-
ference by the defendant'? See Explanatory Notes to
this Section.
2. §1302, Comment f. Is it proper for the jury to
consider the fact that there has been a divorce and the
husband is not required to pay alimony'l See Budd v.
Rounds, 64 Vt. 432.
3. §1305. In Clause (a) the parent or other per-
son's privilege is conditioned upon the reasonableness
of his response to the wife's request for advice; in
clause (b) his privilege is conditioned upon the reason-
ableness of his belief that the wife's welfare will be pro-
mioted by leaving her husband; in Clause (c) his privi-
lege is conditioned upon the reasonableness of his belief
