       Abstract:  Contractul de  intrelinere nu
beneficia de o reglementare legala anterior intrarii in
vigoare a actualului Cod civil, find o creafie a
practicil judiciare si a doctrinei, supus asemeni
oricarui contract nenumit dispozifiilor generale ale
Codul civil de la 1864, din materia contractelor si a
obligaliilor contractuale. Datafiind expansiunea sa si
problemele  pe  care  le-a generat in  practice,
legiuitorul a considerat ca se impune reglementarea
contractului de intretinere.

        1. Efectele contractului de intrefinere
        Obligafiile  creditorului  intrefinerii.
Intretinutul are  obligatiile vanzatorului    i
anume: 1)     sa   transmits   intrefinatorului
dreptul de proprietate  asupra bunului,  mobil
sau  imobil. Este o obligatie de a da, al carei
moment   de executare  este, in principiu, cel al
realizarii acordului de  vointa. 2) ss predea
bunul  transmis.  Este o  obligatie de a  face,
atunci  cand   ea  nu   a  fost  executata   la
incheierea contractului  i cand, firegte, nu s-a
transmis  doar nuda  proprietate a bunului. 3)
ss conserve  bunul  instrsinat pang la predare.
4) ss garanteze  contra evicliunii  i a viciilor
ascunse  ale bunului  instrainat. Neexecutarea
acestor obligatii da dreptul dobanditorului s
invoce  exceptia de neexecutare  (exceptio non
adimpleti  contractus), sa  puns  in functiune
mecanismul garantiilor, astfel cum        este
reglementat   de Codul   civil pentru  materia
vanzarii,   i  chiar  sa  ceara   rezolutiunea
contractului.
        Intretinutul se bucura  de  privilegiul
vanzatorului   de   imobile   pentru   neplata


  THE   CARETAKING CONTRACT (II)

      Abstract: The  caretaking contract did not
benefit from a legal regulation prior to the entry into
force of the current Civil Code, being a creation of the
judicial practice and the doctrine, subject to any
contract not mentioned in the general provisions of
the Civil Code of 1864, in the matter of contracts and
contractual obligations. As a result of the expansion
and  the problems it has generated in practice, the
legislator considered that the regulation of the
caretaking contract was required.

     1. The effects of the caretaking contract
     Caretaking      creditor     obligations.
Caretaking  has  the obligations of the seller,
namely:  1) to convey to the caretaking owner
the  right  of  ownership over the good,
movable   or immovable.  It is an obligation to
give,  whose   moment of execution is, in
principle,   that  of   achieving    the   will
agreement.   2) to hand  over  the transmitted
good.  It is an obligation to do, when  it was
not executed  at the conclusion of the contract
and   when,  of  course,  not  only  the  bare
ownership   of the good was  transmitted. 3) to
conserve    the   alienated   property    until
delivery. 4) to guarantee against the eviction
and  the hidden defects of the alienated good.
Failure  to fulfill these obligations gives the
acquirer   the  right  to  invoke   the   non-
execution  exception  (exceptio non  adimpleti
contractus),   to  put   into  operation   the
mechanism   of guarantees, as regulated by the
Civil Code  for the matter of sale, and even to
demand the termination of the contract.
        The  maintainer  enjoys  the privilege
of  the real estate seller for not paying  the
