I must confess that when I received the invitation
from the Sixth Circuit to come and address this Annual
Conference, I was duly flattered. It is a privilege which
comes to a member of the Bar very rarely, and I asteem
it very highly; but more than that, since I could discover
no merit which would justify the invitation, I attributed
it to friendship, and that I prize even more highly.
I want to say that I am very grateful to the speakers
you have beard this morning. No matter what may hap-
pen in the next few minutes, this day will have been a
great day in the history of Judicial Conferences.
I should also confess to you that as I realized the
-significance of the subject matter which was assigned to
me for discussion, I began to have a few misgivings. I
wasn't quite sure whether the Committee had assigned
to me the subject of Romance in Patent Cases on the as-
sumption that my private life was so austere that my
romantic instincts revolved around the trial of patent
cases, or possibly that my romantic boiling point was so
low that even a patent case could pop me off.
Be that as it may, it has been the habit of a lifetime
with me to treat the wish of my judge as a command, to
reject no assignment, and this subject having been as-
signed to me, I undertook, to the best of my ability, to
discharge it.
I will take my theme from the point where the Chief
Judge left off, and that is the commonly known fact that
the District Judges generally are reluctant to try patent
cases, and, as I think your Chief Judge indicated, it is
because patent litigation has a poor reputation. First,
it is reputed to be dull, tedious, undramatic-in short, a
bore to the judge, to the lawyers and to the spectators.
