OECD 50th Anniversary: the
Updated OECD Guidelines
for Multinational Enterprises
and the New OECD
Recommendation on Due
Diligence Guidance for Conflict-
Free Mineral Supply Chains
Lahra Liberti*
At the Council Meeting at Ministerial Level held on 25 May 2011 under the
Chairmanship of the US Secretary of State, Hillary Rodham Clinton, governments
from 42 countries adhering to the Declaration on International Investment and
Multinational Enterprises, including 34 OECD members and eight non-members
(including Argentina and Brazil), adopted the amendments to the Guidelines
for Multinational Enterprises (the 'Guidelines') as well as the amendments to
the Decision on the OECD Guidelines for Multinational Enterprises on the
implementation of the Guidelines. The update is the result of an intense and
inclusive process. It involved: many OECD bodies; extensive discussions with the
business community, trade unions, major NGOs and international organisations;
and important contributions from South Africa and other non-adhering countries.
On the same day, 41 governments also adhered to the new OECD Council
Recommendation on Due Diligence Guidance for Responsible Supply Chains
of Minerals from Conflict-Affected and High-Risk Areas ('OECD Due Diligence
Guidance'), which provides complementary and detailed recommendations on
responsible supply chain management tailored to the minerals sector.
