Dan BUCUR Director al Directiei de Investigare a Fraudelor Inspectoratul General al Politiei RomAne Abstract* In this article we frame to set forth some practical approaches related to the investigation of criminal offences of smuggling and counterfeiting of cigarettes, test cases identified by officers specialized in the field, statistics of the Ministry of Administration and Interior, as well as personal opinions of the authors in the field of preventing and combating fraud in term s of the industrial property rights regime. Counterfeit cigarettes pose a serious risk to consumers because they are manufactured in production facilities failing to comply with any quality or hygiene standards. Over time, specialized police officers identified counterfeit cigarettes seized in the course of specific actions where these have been identified as a result of surveying, substances which are harmful to health, which normally would not have been allowed in cigarettes manufactured by legal manufacturers - brand holders. Contraband cigarettes and smuggled products are not taxable and annually bring hundreds of millions of euros damage to the Romanian state budget.
