This paper explores the application of artificial intelligence (AI) to alternative dispute resolution
(ADR) by thoroughly explaining what AI is and how it is used in ADR. The paper further discusses
how artificial intelligence dispute resolution (AIDR) expands access to the justice system, reduces
costs, produces efficient results, and lessens power dynamics. Despite AIDR's great applicability,
there are challenges when using this technology such as bias, an impersonal feel to a field that
requires empathy, and risks of professional misconduct. While these flaws exist, they feel more
dramatic due to a human expectation that a computer will produce a perfect result. AIDR is
permanent societal fixture, so instead of harping on its deficiencies, we should take steps to
proactively limit these challenges.
INTRODUCTION
What if people could not determine if the words on this paper words were written by a
robot or a human? Would they feel confident that the content on this paper is accurate? What if
the robot behind this paper drew its content from a collection of human opinions? Would they be
exposed to biases set out by the human programmer?2 Is it wise to entrust programmers,
representing a small fraction of society, to design generalized programs that determine the legal
fate of others?
