'n Mens kan ten aanvang reeds die vraag stel of dit die taak van die staat is om 'n sosiologiese verskynsel soos die huwelik in detail juridies te reguleer. Andrup, Buchhofer en Ziegert wys tereg daarop dat die reg in die eerste instansie 'n beskermings- en nie 'n reguleringsfunksie het nie: The function of law is to protect the living social phenomenon of the family, not the juridical constructions around this phenomenon.'
