The Activities of the Courts in 2008

It has been another dynamic year for the European Courts.Year 2008 has brought about
an important change in Luxembourg, where the Court of Justice has celebrated the
inauguration of its new buildings. Thus, established in its 'new Palais', the Court has
embraced the flourishing caselaw that has marked the past year.
Not only do statistical figures concerning the activity of the Court of Justice
reveal a marked increase in the volume of caselaw brought before it, but also a reduc-
tion in the duration of preliminary ruling proceedings.' The Court completed 495
cases in 2008, and 592 new cases were brought before it. The average time taken to
deal with references for a preliminary ruling reached its shortest in 2008. In the case
of references for a preliminary ruling, the average duration of proceedings was 16.8
months in 2008, as against 19.3 months in 2007 and 19.8 months in 2006. In 2008,
use of the urgent preliminary ruling procedure under Article 104b of the Rules of
Procedure was requested in six cases and allowed in three of them, enabling the Court
to complete those cases in an average period of 2.1 months. The Court also made
frequent use of the possibility enshrined in Article 20 of its Statute of determining
cases without an Opinion of the Advocate General, approximately 41% of the judg-
ments delivered in 2008 compared with 43% in 2007, where they do not raise any
new point of law.
With respect to the Court of First Instance, it may be noted that 605 cases were
decided in 2008, a 52% increase compared with 2007, and that the average duration
of proceedings decreased from 24.5 months compared with 27.7 months in the
previous year.2
The present report revisits a selection of the most salient judgments across the dif-
ferent areas of activity that the Courts have been operating in.

ing rose to 1,178 from 1,154 in 2007, with the attendant risk that the duration of proceedings may increase.
