(ACT NO. 20 OF APRIL 25, 2018)* ** Personal Status Litigation Act (Act No. 109 of July 16, 2003) Chapter I General Provisions Section 2 Court Subsection 1 Jurisdiction of the Japanese Courts Article 3-2: Jurisdiction over Actions concerning Personal Status An action concerning personal status may be filed with the courts of Japan in cases where: (i) an action is filed against either party to the family relationship and the party has his/her domicile in Japan (or residence in Japan, when he/she has no domicile or his/her domicile is unknown); (ii) an action is filed against both parties to the family relationship and one or both of the parties have their domicile in Japan (or residence in Japan, when one or both of the parties have no domicile, or their domicile is unknown); (iii) an action is filed by either party to the family relationship and the other party had his/her domicile in Japan at the time of his/her death; (iv) both parties to the family relationship have died and one or both of them had their domicile in Japan at the time of their death; (v) both parties to the family relationship have the Japanese nationality (in- cluding cases where one or both of them had the Japanese nationality at the time of their death); (vi) an action is filed by either party to the family relationship who has his/ her domicile in Japan and both parties had their last common domicile in * The following translation of the Act for Partial Revision of the Personal Status Litigation Act, etc. (Act No. 20 of April 25, 2018, entering into force on April 1, 2019) has been prepared by Associate Professor Manabu Iwamoto (University of Toyama), Lecturer Miku Koike (University of Toyama), Professor Aki Kitazawa (Keio University), and Professor Yuko Nishitani (Kyoto University). It follows the English translation of Japanese law as provided by the Japanese Government, available at <http://www.japaneselawtranslation. go.jp/>. ** The following are the new provisions inserted into the Personal Status Litigation Act, the Domestic Relations Case Procedure Act, and the Civil Execution Act by the present act.
