THE ENVIRONMENT

Abstract:
Armed conflicts always caused terrible
effects on the environment. It is the major
source of depletion of the natural resources.
Environmental demolition has become an
unavoidable result of modern warfare and
military tactics. It leads to dislocation of
thousands of people which causes intense
pressure on the natural resources of their
campsite. There had been many reflections in
the past which are evident to show the harm
caused on environment due to Armed
Conflict. The World War I, Vietnam war etc
had caused immense destruction to the
Environment.  During   armed   conflict,
international humanitarian law tries to protect
civilians and preserve their survival. As a
result, it also aims to conserve the natural
environment, which is essential for human
survival. The environment is protected by
IHL in two ways: through its general rules
and   some    supplementary,  particular
requirements. The environment is covered by
the general provisions on hostilities. Unless it
has been transformed into a military target,
the environment is normally civilian in nature
and cannot be assaulted. Furthermore, while
determining the proportionality of an attack
on a military target, environmental harm
must be considered. The employment of
methods and means of warfare that are
intended, or may be expected, to cause
widespread, long-term, and serious damage
to the natural environment has been
specifically prohibited in Protocol I.

Retaliatory attacks on the environment are
likewise prohibited under the Protocol. Apart
from it the ENMOD convention also played
a  significant role to  prevent serious
environmental harm. The     International
Committee of the Red Cross amended its
1994 guidelines and incorporate changes in
treaty  and    customary   International
Humanitarian  Law. It issued    updated
guidelines in 2020 that provide crucial
measures that parties to armed conflicts
might use to limit the environmental impacts
of armed conflicts.
INTRODUCTION
Armed conflicts have always wreaked havoc
on the environment. It is the major cause of
depletion of natural resources. The violent
conflict has also resulted in deforestation and
a large-scale refugee exodus. War had bad
consequences for a country. Deaths, bodily
injuries, human relocation, and infrastructure
destruction are among the negative results.
Education and value systems were shattered
as a result of the conflicts. It exacerbates
mental discomfort   and  contributes  to
malnutrition. The  depletion  of natural
resources causes epidemic disease outbreaks.
Human nobility must be protected in all
aspects of the conflict. As a result, the
weaponry and ammunitions employed by
combatants must be regulated in order to
carry out these safeguards for human
nobility. During such periods, law serves as a
tool for regulating human behaviour both
within  a  state's  borders  and  across
international borders.
The worldwide legal order for environmental
protection during armed conflict is based on
a combination of basic principles, treaty
rules, regulations, and judicial decisions. It
includes a number of different types of
