DEMAND RIDESHARING AND MODERNIZE OUTDATED
               TAXI REGULATIONS IN THE US

                             ABSTRACT

        This Note asserts that on-demand ridesharing services should not
be subject to the same strict regulations as traditional taxis because the
innovative, technology-based model of transportation opens up an
entirely new market and distinct regulatory concerns. While many
ridesharing companies appear to provide services similar to that of taxis,
a closer look at the new business model reveals a number of material
differences and concerns that could not have been addressed by outdated
taxi regulations. As app-based ridesharing services like Uber expand into
new cities, the debate is heating up over whether such companies are a
technology middle-man or an unlicensed, unregulated taxi service.
        States should eliminate the legal uncertainty that ridesharing
companies operate under when legislatures do not specifically address
the  regulation  of  on-demand    ridesharing services. States  and
municipalities should adopt clear rules that are tailored to on-demand
ridesharing services and promote, rather than restrict, innovation and
efficiency in the transportation market. Finally the US should encourage
state taxi reforms similar to the Australian State of Victoria, where
deregulation opened up the for-hire transportation market and focused on
encouraging innovative technology, entrepreneurship, and new players in
the transportation industry.
