INTRODUCTION
Mankind has long grappled with its relationship to animals. Just as
the ancient Greek philosophers struggled to fit animals into their world
view, Americans presently wrestle with the concept of what duty man
owes to animal or, indeed, if there are any limits to human use of
animals at all. Recent legal developments regarding the enforcement of
animal cruelty laws have brought the issue of the treatment of animals
into sharper focus. These developments may foreshadow major
decisions on the judicial front. This Note examines the current legal
trends in the animal advocacy movement and the various actors vying
for control of how these trends take shape. By examining these actors
and their goals, this Note attempts to make sense of the current animal
advocacy movement and to evaluate both what the movement has
achieved to date as well as what it can hope to achieve over the next
several years.
Part I of this Note traces the background of animal law and explores
how long-held ideas about animals continue to shape the way that we
view animals today. This Part details the long history of American laws
intended to protect and preserve animals. Part II explores the similarly
long history of individuals and groups trying to strengthen and change
these laws. This Part examines the different branches of the animal
advocacy movement and how these groups vary in their membership,
strategies, and ultimate goals. It contains an in-depth look at the animal
welfare and animal rights movements and at how each arose from a
different philosophy about the place of animals in our moral community.
