The Inter-Relationship between the Humanitarian Laws
and the Law of Human Rights.
By Sean MacBRIDE, S.C. (1),
Secretary General, International Commission of Jurists.
1. Introductory Note.
The purpose of this Note is merely to draw attention to the
dichotemy which has taken place in the evolution and develop-
ment of the Humanitarian Laws and of the Law of Human
Rights. It is not intended to be a review of either of these
codes of international law; these have been reviewed in the
various publications of the International Commission of Jurists.
Now that, following upon the Teheran Resolution, the whole
question of the strengthening of the Humanitarian Laws, both
as regards their content and their effective application to all
armed conflicts, is under active consideration it is very necessary
to underscore the nexus that exists between the Humanitarian
Laws and the Law of Human Rights. There are certain areas
of overlap and certainly there has been very little co-ordination
in the evolution of the two codes.
