1 Inleiding
Alvorens die vryheid om te assosieer ingevolge die Suid-Afrikaanse
arbeidsreg in oenskou geneem word, sal daar oorsigtelik op die
volgende aspekte van die vryheid om te assosieer gewys word:
1 Die vryheid om te assosieer as 'n mensereg;
2 Die vryheid om te assosieer op arbeidsregtelike terrein;
3 Die vryheid of die reg om te assosieer;
4 Die filosofie onderliggend aan die vryheid om          te assosieer;
5 Die vryheid om nie te assosieer nie en die vryheid van disassosiasie;
6 Die vryheid om te assosieer en ander ekonomiese regte:
6.1 Die reg om te organiseer;
6.2 Die reg om kollektiefte beding; en
6.3 Die reg om te staak.
1.1 Die Vryheid om te Assosieer as Mensereg2
Die vryheid om te assosieer kan beskou word as een van die
werknemer se belangrikste individuele menseregte en vorm deel van
bykans al die belangrikste internasionale instrumente wat handel oor
menseregte.3 In hierdie artikel word van die veronderstelling uitge-
gaan dat die vryheid om te assosieer een van die werknemer se

re-establishing a balance in the strength of the parties; it constitutes a healthy counterweight to the
power of the State, by enabling labour to participate in the framing and carrying out of economic
and social policies, and last but not least, it is essential for the proper functioning of an organisation
like the ILO based on tripartism, that is to say co-operation on an equal footing between workers,
