Human-Genomics: A Challenge to the Rules
of the Game of International Law

In addressing the medical, human rights, and trade
implications of human-genomics, the international
legal order faces one of its greatest challenges in
recent decades. The complexity of issues involved and
the difference of opinion over how to deal with
questions such as the patentability of human genes
have led to an unwieldy legal confusion. In this
Article, the author presses for an interdisciplinary
approach to resolving this situation that would take
into account the concerns and the expertise of various
international organizations concerned with health,
trade and human rights. The author also suggests
ways for the international community to engage with
multinational corporations in a way that encourages
cooperation while ensuring the creation of effective
monitoring  devices  and   legal  enforcement  of
international human rights norms. The author calls
for a solution that addresses three primary goals: to
encourage the development of human-genomics and
health care, to ensure wide access to technical and
medical innovations to all people, and to protect the
rights of human subjects who participate in scientific
research. In making the case for an interdisciplinary
and cooperative model of international legal reform to
human-genomics, the author also provides the field of
