Delay in registration of ownership change following inheritance proceedings.
In a judgment delivered on i June zoo6 in the case ofBuj v. Croatia, the European
Court of Human Rights held unanimously that there had been a violation of
the applicant's rights under Article 6, Section i (length of civil proceedings) and
Article 13 (right to an effective remedy) of the European Convention on Human
Rights.
Under Article 41 (just satisfaction) of the Convention, the Court awarded the
applicant EUR z,4oo for non-pecuniary damage.
This judgment became final on i September zoo6 in accordance with Article
44, Section z(b) of the Convention, on the expiry of the three-month time limit
for requesting referral to the Grand Chamber.
i. Principal facts
The applicant, Vinko Buj, is a Croatian national who was born in 1938 and lives
in Jelsa (Croatia).
On i May 1994 the applicant's mother died and inheritance proceedings were
started. On 8 June 1999 in a decision issued by Stani Grad Municipal Court, the
property was distributed between the applicant and his brother. Ownership of the
property was to be registered after the decision became final. An appeal lodged by
the applicant's brother was declared inadmissible and was served on the applicant's
representative in May zoo2. The applicant's ownership of the inherited property
has to date not been recorded in the land register.
2. Procedure of the Court
The application was lodged on i May 2ooz with the European Court of Human
Rights. On 8 December z004 the Court decided to examine the merits of the
application at the same time as its admissibility.
