MISSOURI'S RIGHT TO FARM STATUTE'S
DURATIONAL USE REQUIREMENT AND THE RIGHT
TO FARM AMENDMENT

I. INTRODUCTION
Norris Shrout was born and raised on a family farm in Jackson County,
Missouri in 1956. His grandfather and father have been farming in and around
Independence, Missouri since the end of the 19th century and many things have
changed throughout the years.' When he was a child, the area was mostly rural,
and the family farm did not have many neighbors.2 By the time he graduated
from college, the area had changed quite a bit.' Mr. Shrout stated, There were
two or three housing developments that had developed in eastern Independence
and northwestern Jackson County [Missouri].4' Today, Mr. Shrout farms in a
community in which he would designate as a suburban area, more so now
than it was 20 years ago.'
This urbanization has affected the way that he has to conduct his
business such as being more proactive in making sure gates are closed . . .
constantly checking fences to make sure they haven't been cut or even ran over
by four-wheelers or [dirt bikes], cars, and trucks.' Mr. Shrout is also concerned
by the increase in the number of thefts, ranging from a stolen truck to electrical
wiring stolen from barns, an increase which he attributes to the edge of the
suburban developments moving close to his property.' When Mr. Shrout was in
high school the farm operation had the ability to move cattle up and down the
street between the main operation, located at that time on a two-lane highway,
and other grazing pastures without the worry of speeding, heavy traffic.' Today,
that less-traveled two-lane highway has been expanded to a four-lane divided
highway to accommodate the traffic caused by an increased number of people
