The history of the Federal Trade Commission is the story of the
unfolding of a procedure and enforcement thereunder within
the framework of an Act which gave extraordinary latitude to
men who were just as human and normal as beings should be.
Hence the wave-like advancement and recession in interpre-
tation and enforcement of the Act.1
Introduction
The Federal Trade Commission is now 59 years old, has had 48 Com-
missioners, has initiated countless proceedings and has had a pro-
found effect on the American economy. It is one of the smallest of
the agencies (with annual appropriations of $380,000 in fiscal 1916
and slightly mere than $30 million in fiscal 1973) ,2 but its responsi-
bility is to keep competition, in a free enterprise system that has
produced a Gross National Product in excess of $1 trillion, free and
fair. Almost since its inception, the FTC has been attacked as inef-
fective, inefficient, incompetent, and unfair. This criticism has come
