HUMAN RIGHTS ACT

Preamble
WHEREAS recognition of the inherent dignity and the equal
and inalienable rights of all members of the human family is
the foundation of freedom, justice and peace in the world;
AND this is reaffirmed in the Charter of the United Nations,
and the Universal Declaration of Human Rights proclaims a
common standard for achievement by all peoples and all
nations;
AND in recognition that human rights must be protected by
the rule of law, this legislature affirms the principle that every
person is free and equal in dignity and rights without regard to
race, religion, religious creed, colour, sex, physical handicap,
ethnic or national origin;
AND in recognition that the government, all public agencies
and all persons in the Province has the responsibility to en-
sure that every individual in Nova Scotia is afforded an equal
opportunity to enjoy a full and productive life and that failure to
provide equality of opportunity threatens the status of all per-
sons;
AND it is desirable to enact a measure to extend the statute
law relating to human rights and to provide for its effective ad-
ministration;

Be it enacted by the Governor and Assembly as follows:

Short title
1

This Act may be cited as the Human Rights Act.

Interpretation
2         In this Act,
(a)  business  or  trade  association  includes  an
organization of persons which by an enactment, agree-
ment or custom has power to admit, suspend, expel or
direct persons in relation to any business or trade;
(b)  commercial unit means any building or other struc-
ture or part thereof that is used or occupied or is in-
tended, arranged or designed to be used or occupied
for the manufacture, sale, resale, processing, repro-
cessing, displaying, storing, handling, garaging or dis-
tribution of personal property, or any space that is used
or occupied or is intended, arranged or designed to be

ATTENDU QUE la reconnaissance de la dignite inherente a
I'homme et de droits egaux et inalienables pour tous les
membres de la famille humaine est la pierre de base de la
liberte, de la justice et de la paix dans le monde;
ET que ceci est reaffirme dans la Charte des Nations Unies, et
que la Declaration Universelle des Droits de I'Homme
proclame une norme commune a laquelle se doivent de
satisfaire tous peuples et nations;
ET que, compte tenu du fait que des Droits de I'Homme
doivent 6tre proteges par la loi, cette assemblee legislative af-
firme le principe e l'effet que toute personne est libre et egale
dans sa dignite et ses droits independamment de sa race, sa
religion, sa croyance, sa couleur, son sexe, son handicap
physique ou son origine ethnique ou nationale;
ET considerant que le gouvernement, toutes les agences
publiques et toutes les personnes de cette province ont la
responsabilite de s'assurer que chaque personne, en
Nouvelle-Ecosse, peut beneficier de possibilites, egles de
jouir d'une vie agreable et fecond'e, et que l'inegalite des
chances peut creer de nombreuses situations defavorables;
ET qu'il est souhaitable de decreter une mesure visant a
ameliorer la jurisprudence concernant les Droits de I'Homme
et a faire en sorte qu'elle soit bien administree;
il est decrete ce qui suit par le Gouverneur det lAssemblee:

1        Cette loi pourra etre designee sous le nom de Loi
sur les Droits de I'Homme.
Interpretation
2        Dans cette loi,
(a) association d'affaires ou commerciale comprend un
organisme qui. par decret, entente ou coutume, a le
pouvoir d'admettre, suspendre. expulser ou diriger des
personnes en rapport avec tous commerce ou affaire;
(b) unite commerciale signifie toute betisse ou autre
structure ou partie d'icelle qui est utilisee ou occupee,
ou prevue, amenagee ou conque pour etre utilisee ou
occupee en vue de la fabrication, de la vente, de la
revente, du traitement, de la transformation, de la mise
en montre, de l'entreposage, de la manutention, du
remisage ou de la distribution de biens personnels. ou
